Armelle MONGODIN has been supporting real estate guarantors, insurers, builders, and developers for 25 years in managing their disputes and legal issues.
She has developed significant expertise in sureties and financial guarantees:
- Counter-guarantees from clients and their executives (legal entities, individuals, sureties, autonomous guarantees)
- Agreements with clients (specific conditions for granting guarantee lines)
- Market guarantees (private/public): advance reimbursements, performance bonds, retention of guarantees
- Delivery guarantees at agreed price and timelines
- Extrinsic completion guarantees (VEFA, subdivisions, sale of properties to be renovated, thermal renovation)
- Real estate development (Guarantee of contract performance, guarantee against price overruns, guarantee for the return of the developer’s fee balance)
- “Hoguet Law” guarantees
- Deferred payment guarantees, guarantees replacing immobilization indemnities
- Loan repayment guarantees, particularly for social home purchase loans
- Tourism guarantees
The high volume of disputes related to individual home construction contracts has significantly shaped her practice, allowing her to gain solid experience representing guarantors and builders in all French jurisdictions and in both judicial and amicable expertise throughout France. Additionally, she has developed a particular expertise in sales in the future state of completion, enabling her to address the needs of guarantors as well as developers and non-professional project owners in the healthcare or hospitality sectors.
Graduating with a Master’s degree in Business Law and Economics from the University of CERGY-PONTOISE, Armelle MONGODIN began her legal career in a firm focused on property damage insurance, representing a delivery guarantor. She became a partner at EQUITY JURIS in 2003, took over management in 2007, and joined DELCADE in September 2024.
